Munich Regional Court I finds copyright infringement in AI training, model and outputs
RAUE successfully represented GEMA in its litigation against Suno, the US-based provider of an AI music generator. The Munich Regional Court I granted most of GEMA’s claims for injunctive relief, disclosure and damages.
The Court found that Suno had infringed the copyright in six protected musical works by using them to train its AI, reproducing them within the AI model and reproducing them in its outputs. The judgment is not yet final.
This is the first European court decision to address the use of copyrighted music in generative AI systems. It follows the Munich Regional Court I’s judgment of 11 November 2025 in GEMA’s case against OpenAI. In that case, the Court held that the memorisation of protected song lyrics within an AI model can amount to reproduction for the purposes of copyright law.
