Meta must make Facebook more transparent for the time being

In a summary proceeding, the Higher Administrative Court of Schleswig-Holstein rejected the appeal by Meta Platforms Ireland Limited in a ruling dated 18 December 2025 (see press release). The case concerned whether the Media Authority Hamburg/Schleswig-Holstein (MA HSH), represented by Raue, could determine that the service ‘Facebook’ had violated transparency obligations and demand compliance.

In its decision, the court found substantial evidence of a violation of these transparency obligations. The Higher Administrative Court left the violations of the E-Commerce Directive, the Digital Services Act and the Platform-to-Business Regulation, which were asserted by Meta, to be clarified in the main proceedings. In the summary proceedings, the court found that Facebook’s outstanding importance and market reach justified the special public interest in immediate enforcement.
